These Terms of Service govern the relationship between [ФИРМА], registered at [АДРЕСА], company number (ЕМБС) [ЕМБС], tax number (ЕДБ) [ЕДБ] (the Provider), and any natural or legal person using the iMenu platform at imenu.mk (the User).
By creating an account, the User confirms that they have read, understood and fully accept these Terms.
This English version is provided for convenience. The Macedonian version prevails in case of any discrepancy.
1. Description of the service
iMenu is a software service (SaaS) that allows hospitality venues to:
- create and manage a digital menu;
- choose and customise design templates;
- publish the menu via a web address and QR code;
- translate the menu into multiple languages;
- view basic visitor analytics.
The service is delivered exclusively in digital form. No physical goods are shipped.
2. Registration and user account
The User must provide accurate and complete information at registration and keep it up to date. The User is solely responsible for safeguarding their credentials and for all activity carried out through their account.
The Provider may suspend or close an account where false information, misuse of the service, or breach of these Terms is established.
3. Subscription and activation
The service is provided on a subscription basis, monthly or annually, according to the plan chosen from the current Pricing.
The service is activated immediately upon successful payment, automatically and without delay. The User receives an email confirmation with the activated plan and its expiry date.
The subscription renews at the end of the paid period unless cancelled before that date. Cancellation terms are set out in the Payment, Cancellation and Refund Policy.
4. User obligations
The User agrees not to:
- publish content that is unlawful, offensive, or infringes third-party rights;
- use the service to send unsolicited commercial messages;
- attempt unauthorised access to the system, other accounts, or third-party data;
- resell or transfer the service to third parties without written consent.
The User is fully responsible for the accuracy of their menu content, including prices, ingredients and allergen information.
5. Provider obligations and liability
The Provider makes reasonable efforts to keep the service continuously available but does not guarantee uninterrupted operation. Short interruptions may occur due to maintenance, upgrades, or causes beyond its control.
The Provider is not liable for indirect damages, lost profit, or data loss arising from use or inability to use the service, except in cases of gross negligence or intent.
The Provider's total liability is limited to the amount paid by the User in the preceding twelve (12) months.
6. Intellectual property
All rights in the iMenu platform, its source code, design templates and trademark belong to the Provider.
Content entered by the User (text, images, logo, prices) remains their property. The User grants the Provider a limited licence to store, process and display that content solely for the purpose of providing the service.
7. Changes to these Terms
The Provider may amend these Terms. Users will be notified by email at least 15 days before any material change takes effect. Continued use after that date constitutes acceptance.
8. Governing law and jurisdiction
These Terms are governed by the law of the Republic of North Macedonia. Disputes shall be resolved amicably, failing which before the competent court in [ГРАД].
